These Terms of Use (“Terms”) govern your access to and use of BranchLite, a collection of family-connection visualization tools and related services operated by This Family Love LLC (“This Family Love,” “BranchLite,” “we,” “our,” or “us”).
BranchLite products are designed to help individuals, families, and organizations visualize, explore, create, present, and share family connections.
The BranchLite family of products includes BranchLite Gather and may include additional BranchLite products, features, applications, tools, and services introduced in the future (collectively, the “Services”).
These Terms apply to any BranchLite Service that displays, links to, or otherwise incorporates these Terms, unless separate or additional terms are expressly provided for that particular Service.
By accessing, creating, joining, editing, purchasing through, or otherwise using a BranchLite Service, you agree to these Terms and acknowledge the BranchLite Privacy Policy. If you do not agree, do not use the applicable Service.
BranchLite is the parent brand for a collection of family-connection visualization tools.
Different BranchLite products may serve different purposes and may have different features. Some BranchLite products may allow multiple family members to collaborate, while others may be designed primarily for an individual user.
BranchLite products may help users:
visualize family relationships and connections;
focus on particular family branches, groups, generations, or individuals;
create family-oriented displays;
collaborate on family information;
support family-history or genealogical research;
prepare family information for reunions, celebrations, memorials, or other gatherings;
tell or preserve family stories;
create materials that may be displayed, downloaded, printed, presented, or shared; or
use other family-connection visualization capabilities that may be introduced in the future.
Not every BranchLite product will include every capability described in these Terms.
Features available to you will depend on the particular BranchLite product, version, plan, or Service you are using.
BranchLite Gather is a BranchLite product designed to help families collaboratively visualize the connections among a selected group of family members, including families preparing for reunions, celebrations, gatherings, and other shared family experiences.
BranchLite Gather may allow a Family Champion or other organizer to create a family tree, invite family members to participate through a link or QR code, allow authorized participants to contribute family information, and create a visual representation that can be displayed, downloaded, printed, presented, or shared.
A BranchLite Gather tree may intentionally focus on a particular group of family members—for example, people expected to participate in a family reunion—rather than attempting to represent an entire extended family.
BranchLite Gather is not an event-registration, RSVP, ticketing, admission, payment-collection-for-events, attendance-verification, check-in, scheduling, seating, lodging, or reunion-planning system.
An organizer may place a BranchLite Gather QR code or link inside a separate invitation, registration form, RSVP system, website, email, text message, or event-management platform.
For example, after registering for a family reunion through an external registration service, a registrant may receive a BranchLite Gather link and be asked to add themselves and family members who plan to attend to the family’s event-specific tree.
The event registration remains with the organizer or external registration provider.
Appearing in a BranchLite Gather tree does not independently establish that a person:
registered for an event;
paid an event fee;
has permission to attend;
completed an RSVP;
purchased a ticket;
checked into an event; or
was physically present.
BranchLite Gather should not be relied upon as an official attendance or registration record unless an event organizer independently chooses to use information from BranchLite for that purpose and separately verifies it.
This Family Love LLC may introduce additional products and services under the BranchLite brand.
Unless otherwise stated, these Terms will apply to future BranchLite products that display, reference, or link to these Terms.
A future BranchLite product may have functionality substantially different from BranchLite Gather and may not include collaborative editing, QR participation, gathering-related features, family-tree creation, or other functionality associated with BranchLite Gather.
We may provide supplemental or product-specific terms when a future Service introduces features, transactions, audiences, risks, or legal requirements that are not adequately addressed by these Terms.
If product-specific terms conflict with these Terms, the product-specific terms will control with respect to that product.
Unless different eligibility requirements are displayed for a particular BranchLite Service, you must be at least 13 years old to directly use, edit, contribute information to, or otherwise interact with a BranchLite Service that collects personal information.
Children under 13 should not independently submit personal information through BranchLite unless the applicable BranchLite Service has been specifically designed and authorized for such use.
A parent, legal guardian, teacher acting under an authorized educational process, or other properly authorized adult may add appropriate information about a minor when legally permitted to do so.
BranchLite may develop educational or child-directed Services in the future. Those Services may have different privacy, parental-consent, school-authorization, and eligibility requirements.
Certain BranchLite Services may use different user roles.
For example, in BranchLite Gather, a person who creates or manages a tree may be referred to as a Family Champion, Host, organizer, or similar term.
Other individuals who access or contribute to the tree may be referred to as participants.
Hosts and Family Champions are responsible for determining who should receive applicable join links, QR codes, management links, PINs, or other access information.
Participants are responsible for the information they personally add or modify.
Because certain BranchLite Services are collaborative, another authorized user may be able to add to, modify, or correct information that you entered.
Other BranchLite Services may not include Host, participant, collaborative, or similar functionality.
Certain BranchLite Services, including BranchLite Gather, allow users to enter information about family members and other individuals.
By entering another person’s personal information, photograph, likeness, family relationship, or other content, you represent that you have a reasonable and lawful basis to do so.
For living individuals, you should obtain permission before adding photographs or information that the person would reasonably consider private, sensitive, controversial, or embarrassing.
You should be especially cautious before entering information concerning matters such as:
adoption;
disputed or uncertain parentage;
biological relationships;
estrangement;
sexuality;
detailed medical information;
criminal allegations;
immigration status;
religious beliefs; or
other highly personal or sensitive matters.
BranchLite is intended to help people understand and visualize family connections. It should not be used to expose, embarrass, harass, threaten, investigate, or improperly disclose sensitive information about another person.
BranchLite is not designed to store highly sensitive identity, financial, medical, security, or authentication information unless a particular BranchLite Service expressly states otherwise.
Do not upload or enter information such as:
Social Security numbers;
government identification numbers;
financial account numbers;
complete payment-card information;
passwords;
authentication credentials;
detailed medical records;
genetic test results or raw DNA data; or
similar highly sensitive information.
We reserve the right to remove such information if discovered.
“User Content” means information or materials submitted to a BranchLite Service by or on behalf of a user.
Depending on the Service, User Content may include names, relationships, dates, photographs, family-tree information, stories, descriptions, labels, text, images, or other materials.
You retain whatever ownership rights you have in your User Content.
You grant This Family Love LLC a limited, nonexclusive, royalty-free license to host, store, reproduce, resize, process, display, transmit, and otherwise use User Content only as reasonably necessary to:
provide the applicable BranchLite Service;
generate requested outputs;
enable collaboration or sharing requested by users;
secure and maintain the Service;
troubleshoot problems; and
improve the operation of BranchLite.
This license does not give This Family Love LLC ownership of your User Content.
The license ends when the relevant User Content is deleted from our systems, except for temporary technical copies, legally required retention, backups pending normal deletion, and non-content operational records that cannot reasonably be used to reconstruct the original User Content.
You represent that you have the rights or permissions reasonably necessary for the User Content you submit.
Certain BranchLite Services may allow users to upload photographs, artwork, documents, images, or other materials.
Do not upload copyrighted material unless you created it, own the applicable rights, have permission to use it, or otherwise have a lawful right to use it.
BranchLite may remove content that is alleged to infringe intellectual-property rights.
Copyright concerns may be submitted to:
Certain BranchLite Services, including BranchLite Gather, may provide access through QR codes, join links, management links, PINs, tokens, or similar credentials.
Family trees created through BranchLite Gather are intended to be private or unlisted rather than publicly searchable unless a different setting is expressly provided.
However, an unlisted tree should not be treated as confidential merely because it does not appear in a public directory.
Anyone who obtains a valid join link, QR code, PIN, management link, or similar credential may be able to access or modify the associated Service according to the permissions associated with that credential.
Do not publicly distribute a management link, PIN, private QR code, or other access credential unless you intend the recipient audience to have the associated access.
Host or management credentials should be treated like passwords.
A BranchLite Gather QR code is primarily a method of providing access to the applicable BranchLite experience. It should not be interpreted as proof that an individual registered for, checked into, paid for, or attended an event.
BranchLite is not responsible for access resulting from a user voluntarily sharing, forwarding, publishing, photographing, or otherwise distributing a valid credential.
Notify us promptly if you believe a BranchLite access credential has been compromised.
Certain BranchLite Services display or process family information provided by users.
Unless a particular Service expressly states otherwise, BranchLite does not independently verify:
names;
dates;
family relationships;
photographs;
marriages;
biological relationships;
parentage;
ancestry;
event attendance; or
other family information.
BranchLite outputs should not be treated as legal proof of identity, genealogy, biological parentage, adoption status, inheritance rights, citizenship, event attendance, eligibility for benefits, property rights, or any other legally significant status.
BranchLite is a visualization tool, not an adjudicator of family relationships.
Family-history conclusions should be independently researched or verified when accuracy is important.
Certain BranchLite Services may assist users with organizing, isolating, visualizing, comparing, or otherwise working with genealogical or family-history information.
Unless expressly stated otherwise, BranchLite does not guarantee that genealogical information is accurate or complete.
BranchLite is not a substitute for original records, historical documents, DNA analysis, professional genealogical research, legal determinations of kinship, or other authoritative evidence.
Users should independently verify information before relying on it for significant personal, historical, legal, financial, or family decisions.
BranchLite may offer free, paid, promotional, beta, subscription, pay-per-use, or other types of Services.
Different BranchLite products may have different pricing structures.
Free Services may contain limits involving:
number of people;
number of trees or projects;
exports;
storage;
presentation functionality;
collaboration;
retention;
output formats; or
other features.
For example, BranchLite Gather may limit the number of people who can be added to a free tree before an upgrade is required.
Paid features may include expanded capacity, Presentation Mode, additional exports, longer retention periods, Operator functionality, specialized outputs, or other features described at the time of purchase.
A feature may be marketed for gatherings, genealogy research, education, family storytelling, Family Champions, Operators, or another use case without creating a separate legal entity or platform.
Prices, limits, and features may change prospectively.
We will disclose the applicable price and material purchase terms before charging you.
If BranchLite offers a recurring subscription, the recurring nature of the charge, billing frequency, cancellation method, and other material subscription terms will be disclosed before enrollment.
Refund eligibility, if any, will be disclosed at checkout or in a separate Refund Policy.
When paid BranchLite Services are offered, payment information may be processed by a third-party payment processor.
BranchLite does not intend to store complete payment-card numbers or card security codes on its own application servers.
Your interaction with a payment provider may also be subject to that provider’s terms and privacy practices.
Certain BranchLite Services may allow you to create or download family visualizations as images, PDFs, presentations, files, or other formats.
Subject to these Terms, you may use your exported BranchLite outputs for lawful personal, family, event, educational, historical, organizational, or other permitted purposes.
For example, a BranchLite Gather visualization may be used in:
family handouts;
banners;
apparel;
presentations;
keepsakes;
displays;
family-history materials; or
other family-related products.
Your right to use an exported BranchLite visualization does not necessarily give you rights to photographs, artwork, trademarks, or other third-party content incorporated into that output.
You are responsible for ensuring that you have any permissions necessary for your intended use.
The underlying BranchLite software, user interfaces, proprietary templates, logos, trademarks, technology, and other intellectual property remain the property of This Family Love LLC or its licensors.
You may not clone, reverse engineer, copy, commercially operate, resell, or white-label the BranchLite software itself unless authorized in writing or through an applicable BranchLite Operator, licensing, or similar agreement.
BranchLite is not intended to serve as permanent archival storage. Retention and access periods may differ among BranchLite Services.
BranchLite Gather trees created under the Free or Tree Pass options are generally available for up to 90 days from the applicable creation or activation date shown in the Service, unless the Host ends the session earlier.
During the 90-day access period, authorized users may continue to access the tree according to the features and permissions included with the applicable plan.
BranchLite may display notices or countdown reminders as the end of the access period approaches. These notices are provided as a convenience. Failure to receive or view a reminder does not extend the applicable access or retention period.
Users are responsible for downloading, exporting, printing, applying any desired templates, or otherwise preserving materials they wish to keep before access ends.
A Host may select End Session before the 90-day access period expires.
When End Session is selected, normal access to the tree is deactivated and the tree enters its deletion period.
Tree data is generally scheduled for deletion from BranchLite’s active production systems approximately 30 days after the session is ended.
Ending a session should therefore be treated as the end of normal access. BranchLite does not guarantee that a tree can be restored or reopened during the deletion period.
If a Free or Tree Pass session is not ended earlier, normal access automatically expires at the end of its 90-day access period.
After expiration, the tree enters its deletion period and its data is generally scheduled for deletion from BranchLite’s active production systems within approximately 30 days.
Deletion of a BranchLite Gather tree may include the people, family relationships, photographs, tree information, labels, access credentials, Host information associated with the tree, and other User Content stored as part of that tree.
BranchLite may retain limited non-content records for security, fraud prevention, accounting, payment processing, legal compliance, system administration, or other legitimate operational purposes when reasonably necessary.
Deleted information may remain temporarily in encrypted backups, disaster-recovery copies, or infrastructure-provider snapshots until those copies are overwritten or expire according to the applicable backup schedule.
Backup copies are not intended to remain available to users or to be used as ordinary active storage. If backup information is restored for disaster-recovery purposes, applicable deletion requirements will continue to apply.
Future BranchLite Services may use different access, retention, archival, or deletion periods. Any materially different retention terms will be disclosed through the applicable Service, plan, product description, or BranchLite Privacy Policy.
Users should not use BranchLite as the only permanent copy of important family information, photographs, or other materials they wish to preserve.
Certain BranchLite Services may allow a Host or other authorized user to end or deactivate a session.
For example, ending a BranchLite Gather session may disable further participant access without immediately deleting all stored information.
Deactivated information remains subject to applicable retention and deletion rules described in the BranchLite Privacy Policy.
Where available, users may also request deletion of information by contacting BranchLite.
You may not use a BranchLite Service to:
violate applicable law;
impersonate another person;
harass, threaten, stalk, exploit, or defame another person;
intentionally disclose highly sensitive or private information without authorization;
upload malware or malicious code;
attempt unauthorized access to another person’s tree, project, account, or Service;
interfere with the operation or security of BranchLite;
scrape or systematically extract information without authorization;
circumvent payment, usage, security, feature, or access restrictions;
submit intentionally false information for a fraudulent or malicious purpose;
infringe intellectual-property rights;
misuse another person’s image or likeness;
use BranchLite to falsely establish event attendance or registration;
use BranchLite to falsely establish legal parentage, inheritance rights, citizenship, eligibility for benefits, or other legally significant status; or
use the Service in a way that materially harms BranchLite, This Family Love LLC, another user, or another person.
We may restrict, suspend, or terminate access when we reasonably believe these Terms have been violated.
The BranchLite brand and its associated products, including BranchLite Gather, together with applicable logos, software, interfaces, visual designs, documentation, functionality, proprietary templates, and other intellectual property, are owned by This Family Love LLC or its licensors to the extent rights exist under applicable law.
New products may be introduced under the BranchLite brand in the future.
These Terms do not transfer ownership of BranchLite intellectual property to you.
Nothing in these Terms prevents This Family Love LLC from modifying, renaming, combining, separating, expanding, or discontinuing BranchLite products or product names.
Unless otherwise stated, photographs, illustrations, graphics, family-tree examples, sample visualizations, screenshots, promotional images, marketing materials, website artwork, designs, icons, videos, and other creative materials created by or for BranchLite and owned by This Family Love LLC are protected by copyright and other applicable intellectual-property laws.
You may view these materials for your personal use of the BranchLite Services, but you may not copy, reproduce, republish, distribute, modify, sell, license, commercially use, or create derivative works from BranchLite-owned creative materials without prior written permission from This Family Love LLC.
This restriction does not apply to:
Some images or materials displayed through BranchLite may be owned or licensed by third parties. Those materials remain subject to the rights of their respective owners and any applicable license terms.
Requests for permission to use BranchLite-owned materials may be sent to admin@branchlite.com.
If you voluntarily provide suggestions, ideas, beta feedback, feature requests, product concepts, or other feedback concerning BranchLite, you authorize us to use that feedback to improve, develop, or market our products without obligation to compensate you.
This does not give us ownership of your family information, photographs, stories, or other User Content.
Certain BranchLite Services or features may be offered as beta, preview, experimental, pilot, or early-access functionality.
Beta functionality may:
contain errors;
change without notice;
operate differently from later versions;
experience interruptions;
have additional usage limitations; or
be discontinued.
Users should maintain copies of any outputs or information they wish to preserve.
Participation in a beta may also be subject to additional beta terms or instructions.
BranchLite may link to, integrate with, or operate alongside third-party services.
These may include:
RSVP or event-registration services;
genealogy services;
DNA-testing providers;
printers;
memorial or legacy services;
family-history services;
merchandise providers;
payment processors; or
other partners.
The presence of a link, integration, recommendation, or relationship does not mean BranchLite provides the third party’s services.
For example, linking BranchLite Gather from an RSVP platform does not make BranchLite the event-registration provider.
BranchLite does not control third-party services.
Your use of a third-party service is governed by that company’s own terms and privacy practices.
Some third-party links may be affiliate links through which This Family Love LLC may receive compensation. Where legally required, affiliate relationships will be appropriately disclosed.
We work to keep BranchLite Services available and functioning, but we do not guarantee uninterrupted or error-free operation.
Maintenance, software updates, hosting failures, internet outages, security events, third-party failures, or circumstances outside our control may temporarily affect a Service.
Because BranchLite is a developing family of products, we may modify, rename, expand, combine, separate, replace, suspend, or discontinue Services or features.
A particular feature appearing in BranchLite Gather does not mean that feature will be offered in every future BranchLite Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANCHLITE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
THIS FAMILY LOVE LLC DOES NOT WARRANT THAT A BRANCHLITE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR THAT USER-SUBMITTED FAMILY INFORMATION WILL BE ACCURATE OR COMPLETE.
BRANCHLITE SERVICES ARE FAMILY-CONNECTION VISUALIZATION TOOLS.
UNLESS EXPRESSLY STATED OTHERWISE FOR A PARTICULAR SERVICE, BRANCHLITE IS NOT AN EVENT-REGISTRATION SERVICE, ATTENDANCE-VERIFICATION SERVICE, PROFESSIONAL GENEALOGY SERVICE, DNA-TESTING SERVICE, LEGAL SERVICE, MEDICAL SERVICE, FINANCIAL SERVICE, OR PROVIDER OF PROFESSIONAL ADVICE.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
To the maximum extent permitted by law, This Family Love LLC and its owners, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of a BranchLite Service.
This includes, without limitation, damages relating to:
loss of data;
loss of photographs;
loss of family information;
inaccurate family information;
reputational harm;
family disagreements;
disputed relationships;
event-registration disputes;
attendance disputes;
unauthorized sharing by another user; or
reliance on User Content.
To the maximum extent permitted by law, our total liability relating to a BranchLite Service will not exceed the greater of:
the amount you paid to BranchLite during the twelve months preceding the event giving rise to the claim; or
$100.
Nothing in these Terms limits liability that cannot legally be limited.
To the extent permitted by law, you agree to be responsible for claims, damages, losses, liabilities, or expenses resulting from:
User Content you submitted;
your violation of these Terms;
your infringement of another person’s rights; or
your unlawful or unauthorized use of a BranchLite Service.
Our collection, processing, use, sharing, retention, and deletion of personal information is described in the BranchLite Privacy Policy, available at:
https://branchlite.com/privacy
The BranchLite Privacy Policy applies across BranchLite Services that reference or incorporate it unless a particular Service provides a supplemental or separate privacy notice.
We may restrict, suspend, or terminate access to a BranchLite Service when reasonably necessary to:
protect users;
protect BranchLite;
comply with law;
address security concerns;
prevent fraud or misuse; or
enforce these Terms.
You may stop using a BranchLite Service at any time.
Termination of access does not automatically override applicable data-retention, transaction-record, backup, security, or legal requirements.
We may update these Terms as the BranchLite family of products evolves.
The revised Terms will display a new effective date.
We may also introduce new products, discontinue products, rename Services, or modify functionality without requiring a separate Terms agreement unless the change materially affects your rights or obligations or applicable law requires additional consent.
When changes to these Terms are material, we may provide additional notice through the applicable BranchLite Service or website where reasonably appropriate.
Your continued use of a BranchLite Service after revised Terms become effective constitutes acceptance of those Terms where permitted by law.
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
Any dispute not otherwise resolved between the parties may be brought in a court of competent jurisdiction in Georgia, subject to rights you may have under applicable law.
